Pre-Purchase Inspection — Terms & conditions.

Pre-Purchase Vehicle Inspection Service. Please read these terms carefully before booking an inspection. By booking our inspection service, you agree to be bound by these terms.

1. About These Terms

These terms and conditions govern our pre-purchase vehicle inspection service. In these terms, “we”, “us” and “our” refer to IAG NZ RepairHub Limited, and “you” and “your” refer to the person who books and pays for the inspection.

2. Our Service

Our technician will carry out a visual inspection of the vehicle you nominate, limited to the specific elements set out in the “What’s included” section on our website at the date and time of your booking. If an element is not listed, it is not part of our service, regardless of its importance to the vehicle’s condition or value.

3. What our Report will cover

Our report will include an inspection of those items that are available as part of our service and that are applicable to your vehicle. Please note some items on this inspection checklist may not be applicable to your vehicle. A list of the items we inspect, and a sample report is available on the “What’s included” section on our website.

Our inspection does not cover everything about the vehicle. In particular our inspection:

  • is visual only and does not include the dismantling of any part of the vehicle. There may be faults or defects that are not reasonably discoverable through this type of inspection.
  • will reflect the condition of the vehicle only as at the time and date of the inspection as stated in the report
  • does not cover any hidden defect, or any defect not immediately apparent at the time of inspection.
  • does not cover any fault or defect that arises after the date of the inspection
  • does not include the review by us of any documentation or third-party data in relation to the vehicle or any finance in relation to the vehicle (including information supplied by third parties as part of the report provided to you)

Road testing will only be carried out at the discretion of our technician and only for roadworthy vehicles that also have a current warrant of fitness, a valid registration on New Zealand’s motor vehicle register and are adequately fuelled. Road testing is limited to the speeds in force in the immediate area of where the inspection is carried out.

We do not provide any opinion or advice on the market value of the vehicle, nor will we give advice on whether the vehicle is fit for any particular purpose.

Our service does not include inspection of motorbikes, buses, trucks or commercial vehicles with a gross vehicle mass (GVM) over 3.5 tonnes and we reserve the right to refuse to conduct an inspection on any vehicle for any reason.

Where we conduct a battery test for an electric or hybrid vehicle, we will only provide an estimation of the state of health of the main battery. We do not give any warranty as to this estimation nor the future state of the health of the battery, or the likelihood of degeneration.

Information in the ‘Vehicle Report’ section of the report (including vehicle identity, odometer readings, Warrant of Fitness, registration, registered owners, security interest, police, and importation status) is supplied by CarJam Online Limited. We do not warrant and are not liable for the accuracy or completeness of this information or any third-party data that is provided to you in the report.

4. The Report

Once we have completed the inspection, a copy of our report will be emailed to you at the address you have provided.

Please be aware that our report is prepared for your personal use only. We are not under any obligation to provide it to a third party, and we accept no responsibility to any person other than you in connection with our report.

5. Your Responsibilities

You must ensure that the vehicle is made available for inspection at the agreed time and location. We will carry out inspections at approved MotorHub sites or at a nominated Auckland based location of your choice provided that, the location is reasonably accessible to allow an inspection to take place. The vehicle must be clean to allow for a visual inspection and where applicable able to be road tested. You must have the authority of the vehicle’s owner to arrange the inspection. If these requirements are not met our technician may decline to carry out the inspection and we may charge a cancellation fee.

6. Charges and Cancellation

You must pay the fees for the inspection at the time of booking. Our fees and charges are set out in the “Pricing” section on our website. Some vehicles such as luxury or imported vehicles may require additional time to complete the inspection and may be subject to additional charges. These charges will be notified to you prior to the inspection.

All our fees and charges are subject to change without notice.

If you cancel a booking before the inspection begins and in the case of mobile inspections if our technician has not yet arrived at the nominated location, you are entitled to a full refund. If, in the case of a mobile inspection our technician has already arrived at the nominated location when you cancel or you fail to attend the nominated location at the scheduled inspection time, you are entitled to a 50% refund only.

Refunds will be processed by electronic bank transfer. Please allow up to 7 to 10 working days for the refund to settle in your bank account.

We reserve the right to refuse to carry out a vehicle inspection or to change the time of your booking for any reason. If we are unable to carry out an inspection, we will refund any inspection fees paid by you.

7. Limitation of Liability

Nothing in these terms excludes or limits any rights you have under the Consumer Guarantees Act 1993 or any other legislation that cannot be excluded or limited by agreement.

If you are in trade and acquiring the Pre-purchase Vehicle Inspection for business purposes, you acknowledge that the Consumer Guarantees Act 1993 does not apply to the services and report supplied to you; and you agree that sections 9, 12A, and 13 of the Fair Trading Act 1986 do not apply to the services and report supplied to you.

Our total liability to you in connection with the inspection and the report, whether arising in contract, tort (including negligence), or otherwise, is limited to the price you paid for the inspection. This cap applies to all claims of any kind arising out of or in connection with our service.

We have no liability to you for any vehicle defects, whether identified or not during the inspection.

We are not liable for any indirect or consequential loss, including (without limitation) any loss you suffer as a result of purchasing or not purchasing the vehicle, any loss of profit, or any costs of repairing faults not identified in the report.

Any repair work that is carried out on your vehicle by us following the inspection is outside the scope of these terms.

8. Privacy

The way that we will collect and use your personal information is explained in our Privacy policy. By using our services, you are permitting us to collect, hold, use and share your personal information in accordance with our Privacy Policy. If you give us information about someone else, you are confirming that you have their authority to disclose it. You have the right to access and request correction of any personal information we hold about you.

9. Complaints

If you have a concern or complaint about our service, please contact us at 0800 888 950 or via the Complaints Process on our website. We will do our best to resolve any issue promptly and fairly.

10. General

These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction over any dispute arising under them. If any provision of these terms is found to be illegal, invalid or unenforceable then that term shall be severed and the remaining provisions will continue in full force and effect.
